Attorneys or individuals say no to drug court
Currently reporting on Whitfield County Drug Court.
Many may ask what made me decide to voice some facts about this system, and just how broken it is. Not only did my domestic partner come into the program on July-3rd-2014 but being a very supportive partner I attend every court hearing I could, they have court once a week every Thursday. The hole time he kept saying he could not take them ridiculing and being so harsh with him. I more or less ignored the problem, now I greatly regret I did. I said you tuff you can get through this, keep your chin up and let their words not bother you. I being someone that words will hurt me faster than a hit or anything, should have never said that. The public defender talked him to drug court, saying it was the best. I have found out just how often they try to push drug court on people as part of plea just so they can get the case off their desk. On Feb-12-2015 my partner had to go to court and is currently in jail. That day at court a gentlemen in the program stood up to talk to judge about how he could not take the staff anymore and was willing to go to jail, just to let him out of this program. Please note this gentlemen was in phase 5 the last phase of the program. He had many other participants of the program with him. I don't know what happened after court but I felt his words was just taken in vain.
The accountability of courts says they are to treat not incarcerate, that's not true I don't think I have ever been in a court session that someone was not incarcerated to jail or sent to prison. They ignore the real problem, I asked many time for my partner to have a mental evaluation because of prior diagnoses, I did not feel he could be treat without addressing the mental issues from childhood and beyond. He was never evaluated and there sites and literature states The Office of Accountability Courts and Grants Management provides support, technical assistance, and training opportunities to accountability court and grants. These programs include drug, mental health, DUI, family dependency, veterans, and child support courts. This is not true, at one time I was a great supporter of this system, but seeing firsthand how it works I am no longer a supporter and am currently asking the state of Georgia for an investigation into this. If they had completed a physiological examination as I asked for many times from several on staff, he would not currently be in this situation and would be home not incarcerated. I am asking everyone to step up and help me make a change in the system. He and many other have been treated so gravely unfair I cannot sit back and say nothing any longer. My partner has served more time in jail than he would had if he had took the DA's second offer as a first offender, 45 days in county jail. All because he was not given the help he really need by the drug court staff.
Also I would like to point another messed up fact. The public defender assigned to his case is on the drug court team, to me that made me feel the public defender is working for them and not on his side unconstitutional is how we both feel about this totally messed up system. Thankfully over the past few days I have been able to find a privet attorney willing to help and I am overly grateful our paths crossed, attorney Mark S.
